This statement is provided pursuant to 18 U.S.C. § 2257, 18 U.S.C. § 2257A, and the implementing regulations at 28 C.F.R. Part 75, and applies to fetish.haus, operated by FetishHaus Ltd.

With respect to all visual depictions of actual sexually explicit conduct appearing in, contained in, or otherwise linked from the Site, all persons appearing in such visual depictions were at least eighteen (18) years of age at the time the visual depictions were created, produced, or photographed.

The Company does not produce, host, distribute, or otherwise make available any visual depiction of actual sexually explicit conduct, or any matter required to be reviewed under 18 U.S.C. § 2257, involving any person under the age of eighteen. Age and identity are verified for every Creator and for every person depicted in Content before publication, consistent with the Platform's review-then-publish moderation process — no Content auto-publishes.

The records required by 18 U.S.C. § 2257 and § 2257A and by 28 C.F.R. Part 75, with respect to the visual depictions described in this statement, are maintained by the Custodian of Records identified in Section 4, at the physical United States street address stated there. These records include, as applicable: the legal name (and any known aliases, stage names, professional names, maiden names, or nicknames) of each person depicted; the date of birth of each such person; a legible copy of a government-issued photographic identification document used to verify identity and age; the title or identifier of each visual depiction; and a cross-reference index sufficient to locate the records for any depiction.

To the extent any Content on the Site consists of visual depictions of simulated sexually explicit conduct, the record-keeping and labeling provisions of 18 U.S.C. § 2257A and 28 C.F.R. Part 75 apply to those depictions. The Company maintains, or relies on the Creators who are primary producers to maintain, records establishing that all persons appearing in any such depiction were at least eighteen years of age at the time it was created, in the manner required by § 2257A.

The Custodian of Records for the records required under 18 U.S.C. § 2257 and § 2257A and 28 C.F.R. Part 75, with respect to the Content described in this statement, is:

The designation of the Custodian of Records and the physical United States street address at which the required records are maintained will be published here upon completion of the designation. Until that designation is published, no visual depictions of actual sexually explicit conduct subject to 18 U.S.C. § 2257 are made publicly available on the Site.

When published, the designation will state a physical United States street address (not a post office box) at which the required records are maintained and available for inspection as provided by law during regular business hours.

The Platform hosts Content uploaded by verified Creators. Each Creator is the primary producer of the Content that Creator uploads and is contractually required, under the Creator Agreement, to: create, organize, and maintain the records required under §§ 2257/2257A and 28 C.F.R. Part 75 for every visual depiction they upload, including every depicted person and collaborator; confirm and document that every person depicted was at least eighteen at the time of production, supported by a government-issued photographic identification document; and produce those records to the Company, the Custodian of Records, or authorized inspectors upon request.

Verification of every Creator and every depicted person is performed through the Company's identity- and age-verification (KYC) process. The Company maintains the records described in this statement for Content it hosts to the extent required of it by law, and relies on each primary-producer Creator to maintain the underlying records for that Creator's Content. Nothing in this statement transfers, diminishes, or relieves any Creator of their independent obligations as a primary producer under federal law.

This statement applies only to visual depictions subject to 18 U.S.C. § 2257 or § 2257A. Content that does not depict actual or simulated sexually explicit conduct, and any other matter exempt from those statutes and 28 C.F.R. Part 75, is not subject to the record-keeping requirements described here. The exemptions and definitions in those provisions are incorporated by reference.

This statement supplements, and should be read together with, the Age Verification Policy, Acceptable Use Policy, CSAM Policy, Anti-Slavery Policy, NCC Policy, and Terms of Service, which incorporates it by reference. Actual identification records collected under this program are retained internally and are not published; they are disclosed only as required or permitted by law.
